These regulations establish the rules for making purchases in the Doctor Nap® online store.

1. General Provisions

The Doctor Nap® store, referred to as the Store in the following regulations, manages the sale of goods through the Internet. Placing and confirming an order is equivalent to accepting the following Purchase Regulations and agreeing to its provisions before entering into a purchase-sale transaction, as well as consenting to the processing of the Consumer's personal data by the Seller for the purposes related to placing an order. Personal information is not shared with other entities for marketing purposes. A placed order constitutes a purchase-sale agreement within the meaning of the Civil Code. Orders can be placed 24 hours a day, 7 days a week, throughout the year (the Store acknowledges the existence of technical breaks that prevent the Store from accepting and processing Consumer orders). The realization of Consumer orders takes place on business days (excluding statutory non-working days), usually within 24-48 hours from the time the order is confirmed by the Consumer or at the moment when the Store has collected all products ordered by the Consumer and/or received the full payment for the order. Consumers of the Store are individuals who have reached 13 years of age (Civil Code, Art. 11-24). If this condition is not met, the purchase-sale agreement is void.

2. Placing Orders

An order is placed by the Consumer when adding products from the Store's offer to the cart and filling out the Order Form. An order can also be placed by phone or by email. When placing an order, the Store asks the Consumer to provide accurate contact information. An error in the Order Form may cause difficulties or even prevent the order from being processed. After placing an order, the Consumer will receive an email confirmation of the order being accepted for processing. In the absence of such information, the Consumer should contact the store by phone or email. The Store has the right to verify the placed order in cases that raise doubts about the possibility of fulfilling the order, as well as to cancel the order in case of non-payment. Payments for ordered products can be made upon receipt, through PayU, PayPal, or bank transfer. Payment methods are described on the website: Delivery Conditions. If payment is not made within 7 days from the date of placing the order, the Store reserves the right to cancel the order. In the case of unavailability of some products in the order, the Consumer is informed by the Store about the order status. The Consumer can then decide on how to proceed (partial fulfillment, extension of waiting time, cancellation of the entire order). In the absence of a response within 3 days from the Consumer's side, the Store reserves the right to send the available items in the order or to cancel the order. The time it takes for ordered products to reach the Consumer consists of the time it takes to obtain the goods (specified for each product) and the time it takes for Poczta Polska / the courier to deliver the shipment to the address specified by the Consumer, with only business days taken into account. - expected delivery date = time to obtain the goods + delivery time - on the day of dispatch of the order, the Consumer is informed about this fact in an email message. All products offered in the Doctor Nap® store are brand new, free from physical and legal defects, and have been legally introduced into circulation in the Polish market. A limited number of goods are allocated for promotional and clearance sales. Order fulfillment takes place in the order of confirmed orders received. In the event of stocks being depleted for this form of sale, the Store reserves the right to adjust the order or cancel it. All prices shown on the Store's website are in Polish zlotys and are gross values (including VAT). These prices do not include flat-rate shipping costs. A detailed breakdown of the shipment's contents, along with a list of costs, is attached to each order and included in the shipment with the product ordered by the Consumer. The Consumer has the right to request that a detailed breakdown of the shipment's contents not be included in the package. The Consumer can cancel a placed order by phone or email to the address sklep@doctornap.com until the order is transferred by the Store for packaging. In the case of orders consisting of several items to be delivered in one package, the delivery time will depend on the time it takes for the Store to complete the last element of the given order, unless the Store and the Consumer agree otherwise.

3. Delivery

The delivery of an order takes place by sending the ordered goods to the address specified by the Consumer through available freight services (carrier), e.g., Poczta Polska / courier company. The cost of delivery is added to the order according to the shipping cost table. According to the "Civil Code," when sending the sold item through a carrier, the Consumer is obliged to check the condition of the shipment upon receipt. If any shortage or damage to the item is found, the Consumer must take all necessary actions to determine the carrier's liability, informing the Store of this fact: writing a protocol specifying the condition of the shipment and the circumstances of the damage and signing it simultaneously by the carrier and the recipient of the shipment. The method of inspecting the shipment is regulated by the Transport Law (Article 74 and following). The legislator provided that accepting the shipment by the recipient (Consumer) without reservation results in the expiry of claims for shortages or damage to the shipment.

4. Withdrawal from Purchase

A Consumer who has concluded a distance contract has the right to withdraw from it within 30 calendar days without giving reasons by submitting an appropriate written statement to the Store. The 30-day period in which the Consumer can withdraw from the contract counts from the day the goods are delivered. Sending the declaration before its expiry is sufficient to meet this deadline. In the event of withdrawal from the contract, the contract is considered not concluded, and the Consumer is released from all obligations. What the parties provided is subject to return in an unchanged state, unless a change was necessary within the limits of ordinary management. The return is only possible if the item shows no signs of use, is complete, and has not been damaged in any way. Along with the returned item, the Consumer is required to return all products received for free. Including the sales document in the package would be appreciated. The return of the goods should take place promptly, no later than within 30 calendar days. The cost of returning the goods is borne by the Consumer.

5. Complaints

The Store is liable for warranty when the item sold by it is defective (defect - reducing the value of the item, usefulness of the item, when the item does not have the properties that were described in the Doctor Nap® store service, when the item was issued in an incomplete state, incomplete), and at the time of concluding the contract, the Consumer was unaware of it. The condition for maintaining the right

 to use the complaint is to notify the defect in writing on the appropriate form available on the Doctor Nap® website within 1 month from the date of discovering it. From the warranty, the Consumer is entitled to: withdraw from the contract, reduce the price, exchange the defective item for another one without defects, remove the defect. The complaint will be considered by the Store within 14 days from the date of receipt of the complained product along with the required documents. If necessary, obtaining the opinion of an expert may extend the complaint consideration period to 21 calendar days.

6. Final Provisions

The Doctor Nap® store makes every effort to ensure that the product descriptions presented on the website are consistent with the actual state. However, in case of any doubts, please contact us by phone or email at sklep@doctornap.com before placing an order. The Store undertakes to protect personal data in accordance with the Act of August 29, 1997, on the protection of personal data (Journal of Laws of 1997, No. 133, item 883). According to this law, Consumers of the store have the right to access their data, correct them, request their deletion, or request their discontinuation of use. The Store covers the costs of shipping in the case of exchanging goods due to incorrect order fulfillment by Doctor Nap® up to the amount specified below. The Consumer covers the shipping costs to Doctor Nap®. In case of an error, the Store will refund the Consumer the cost of shipping to the Store in an amount resulting from the amount on the shipping list and not exceeding 13 PLN (in words: thirteen Polish zlotys). At the same time, the Store informs that it does not accept any parcels sent to the Store for cash on delivery. In the case of a paid order, when the Store is unable to fulfill the order in its entirety, the store informs the Consumer of this fact. In the case of canceling the missing item or the entire order, the Store will refund the prepayment to the bank account or card specified by the Consumer within 3 business days from the date of canceling the order or its correction. The information contained in the Store does not constitute an offer within the meaning of Article 66 of the Civil Code; it constitutes an invitation to conclude an agreement within the meaning of Article 71 of the Civil Code. These regulations come into effect as of March 13, 2013.
